TERMS OF PURCHASE
According to the terms of purchase, the buyer can be any physical person or legal entity who orders at least one product, enters the required information and pays the ordered product through the Website www.nashecosmetics.hr, owned by NASHE COSMETICS d.o.o. Viška ulica 24, 52100 Pula, VAT: HR 19893540371.
The recipient is the person to whom the product is delivered, regardless of the buyer.
If a legal entity is entered in the information about the buyer’s data, the buyer is considered a legal entity, and the physical person whose data is entered is considered the authorized entity of the buyer – legal entity.
The buyer is responsible for the accuracy of all entered information.
The supplier of the ordered products is NASHE COSMETICS d.o.o., Viška ulica 24, 52100 Pula, Croatia, VAT: HR 19893540371.
Accepting the Terms of Sale, the buyer must be of legal age and capacity. The buyer is responsible for the accuracy and completeness of the information entered during registration.
1. Buyer registration
The buyer can register through the ordering process by clicking “Register me” after entering the payment information and entering a password.
Except through the buying process, the buyer can register by clicking on the “Login” option at the top right of the screen and then selecting “Registration”. The buyer must fill out the form with his/hers personal information (name, last name, e-mail address, address, phone number) and a password. The buyer must log in with each purchase, entering the data from the registration, which are referring to the customer profile. To register, the buyer must be 18 years or older. By creating an account at NASHE COSMETICS Web shop, the buyer can quickly and easily go through the purchasing process, set up multiple shipping addresses, view and track his/hers orders and much more, also be the informed about promotions and coupons.
Visitors of the web shop nashecosmetics.com can order and buy as a guest or as a registered user.
Whether the buyer is a registered user or purchasing as a guest, the buying process is as follows:
- Choose the desired item. For more information on the chosen item, please click on the image or the name of it, after which you will be redirected to the more information about the product. By pressing “Add to cart” the product will be automatically placed into your cart. In the cart you have an overview of all the items you have chosen (added to cart), the price and the quantity. You can change the amount of an item by entering the desired amount in the “Quantity” field. If you want to empty the cart, click on the “Remove” option next to each item.
- When you have completed the selection of the desired items and decided to buy them, click on “Checkout” and complete the data entry process.
- Enter email, first and last name, address where purchased items shall be shipped, city, country, region, Zip/Postal Code, and telephone number then click “Continue”.
- Now you can review the order, to complete the ordering process click “Place order”.
The prices shown on the web page next to each product are valid for all forms of payment and are expressed with VAT already included.
When ordering, the cart will indicate the shipping and packaging price of the product.
Shipping and packing price are not included in the product price.
Upon receipt of the information from the order, a message will be displayed on the screen that the buyer’s order has been received and the order number will be indicated.
You will receive your order confirmation on the email address you provided during the purchase process.
In case you did not receive the e-mail, please check the cart, if the cart is empty after ordering, contact us by email at: email@example.com or directly by phone at +385 989627278 or +385 912755553 (Mon-Fri 9am-4pm GMT+1).
If NASHE COSMETICS d.o.o. does not dispose of the ordered product because of the shortage of goods in the warehouse, the buyer will be informed in due time. In the above case, if Bank Deposit or paying-in slips is selected as a form of payment, NASHE COSMETICS d.o.o. will repay the funds paid.
In case of the above payment, the buyer shall be liable and bear the risk of the accuracy and veracity of the information provided, since NASHE COSMETICS d.o.o. will make a refund in accordance with the information provided.
If the payment for the ordered product is made by making a deposit into NASHE COSMETICS d.o.o. bank account, NASHE COMETICS d.o.o. agrees to reserve the product for 3 working days. After 3 working days, NASHE COSMETICS d.o.o. does not guarantee product availability.
Only products that are indicated in the order may be subject to order and are not available in stock but are available within 30 business days, not including Saturday.
Only products that are indicated as on stock and products out of stock that will be available within 30 business days, not including Saturday can be subject to order.
Online shopping is available for the delivery in the following countries:

If the buyer wants to order the products for delivery to a country that is not in the list above, he/she can send a direct order.
To place a direct order the buyer can email his personal information (first and last name, phone number, street and address, postcode and country) and the list of products he wants to order at firstname.lastname@example.org.
The buyer can also place a direct order by calling +385 989627278 or +385 912755553, to place the direct order by phone, the buyer must provide the above stated information and e-mail address.
NASHE COSMETICS d.o.o. will electronically submit an invoice for the order placed within 3 business days of receiving the direct order.
NASHE COSMETICS d.o.o. agrees to reserve the product in stock until the time of the invoice submission and, 3 additional business days from the time of the offer submission. After 3 business days of submitting the offer, NASHE COSMETICS d.o.o. does not guarantee product availability.
If Bank Deposit or paying-in slips is selected as a form of payment, the order will be considered completed after NASHE COSMETICS d.o.o. receives an electronic confirmation that the order amount has been paid.
NASHE COSMETICS d.o.o. undertakes to deliver the product ordered by direct order within the shortest possible time, within 30 working days from the date of conclusion of the contract.
When paying on delivery, the order will be considered completed after the purchase process is completed.
All prices on the Website www.nashecosmetics.com/en in the Croatian language are in Croatian national currency, Croatian Kuna (kn; HRK), VAT included. All prices on the Website www.nashecosmetics.com/en in English are expressed in European Union currency, euro (€; EUR), VAT included.
Payment for the product price and shipping and packaging costs can be done in one of the following ways:
Cash on delivery.
When picking up a shipment, the shipper is paid the full amount indicated in the bill, which includes the price of the product and the cost of shipping and packaging.
Cash on delivery is only available for delivery within Croatia.
Payment through internet banking.
Ordered products can be paid through Internet banking of any bank by paying the amount stated in the cart, which includes the price of the product and the costs and packaging.
Payment through paying-in slip.
Ordered products can be paid through paying-in by paying the amount stated in the cart, which includes the price of the product and the costs and packaging.
Payment via PayPal service
Ordered products can be paid online using the PayPal service.
Ordered products can be paid online once using one of the following cards: Diners, Discover, Maestro, MasterCard or Visa.

4. Shipping and delivery
Products can be ordered via the web shop for delivery in the following countries: Austria, Belgium, Bosnia and Herzegovina, Bulgaria, Czech Republic, Denmark, Estonia, Finland, France, Croatia, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxemburg, Hungary, Netherlands, Germany, Norway, Poland, Portugal, Romania, Spain, Serbia, Slovakia, Slovenia, Switzerland, Ukraine, United Kingdom.
Products can be ordered through direct order for worldwide delivery.
Delivery of products ordered through the web shop is done through verseas Express, DPD delivery, HP delivery or other delivery.
Delivery of products ordered by direct order is done via Overseas Express, DPD delivery, HP delivery or other delivery.
Shipping is not included in the price of the product, unless otherwise stated (indication – shipping is).
Shipping costs include product packaging.
The buyer is responsible for paying taxes and duties in accordance with the laws of his country.
Delivery is made according to the terms of business of the delivery service, and is considered to have been made at the time of delivery of the product to the delivery service.

Shipping takes place within 2 business days after NASHE COSMETICS d.o.o. has received a completed order.
NASHE COSMETICS d.o.o. agrees to deliver the product ordered through the web shop www.nashecosmetics.com within 15 working days of the conclusion of the contract.
NASHE COSMETICS d.o.o. undertakes to deliver the product ordered by direct order within the shortest possible time, within 30 working days from the date of conclusion of the contract.
NASHE COSMETICS d.o.o. is obliged to deliver all ordered products that are in stock at the time of delivery.
If NASHE COSMETICS d.o.o. cannot deliver any ordered product, the buyer will be contacted to discuss the possible replacement of the ordered product. All other products ordered will be shipped.
The package is delivered to the address with which was entered as contact during the buying process.
5. Upon delivery
Ordered products are packed in such a way that they will not be damaged during delivery. When purchasing the goods, the buyer is obligated to check the condition of package and, in the case of damage, immediately report the product to NASHE COSMETICS d.o.o.. In the case of a package visibly damaged in transit, buyer and recipients are advised not to pick it up. Buyers are requested to contact NASHE COSMETICS d.o.o. to overcome possible difficulties. If any of the products is damaged, buyers areadvised to immediatly contact NASHE COSMETICS d.o.o., and follow the instructions of the delivery service:
- contact the delivery service Customer Service and state the shipment number on the label on the package
- preserve the package and its content (wrapping included)
- contact NASHE COSMETICS d.o.o. (be sure to state the complete content of the package)
It is also advised to:
- take a photo of the package and send the photo to email firstname.lastname@example.org
- not change the contents of the package in order to determine the actual state of the contents of the package
- not use anything in the package because it is considered that you have acknowledged its correctness by using the content and that the damage occurred to you and not during delivery
- not return the package to the sender before you have agreed this with NASHE COSMETICS d.o.o.

When NASHE COSMETICS d.o.o. delivers the product via the delivery service to the buyer or recipient, the buyer or recipient is obliged to take over the product by signing the invoice, thus confirming that the product has been duly delivered.
The buyer is free to refuse to receive the package damaged in transport and will not be charged for shipping costs.
By refusing to receive a damaged package, the delivery service will return the shipment to NASHE COSMETICS d.o.o.
If the product sent to the buyer or recipient is returned to NASHE COSMETICS d.o.o. as the delivery service failed to deliver, the customer will be notified by email and offered the following options:
- to resubmit the ordered product, at the buyer’s request by e-mail, to the buyer’s or recipient’s address;
- to pick up the ordered products at NASHE COSMETICS d.o.o. Verudela 8, 52100 Pula, Croatia with prior telephone agreement on the pickup date.
Telephone agreement on the pick-up date is possible by calling +385 989627278 or +385 912755553 weekdays, excluding Saturday, between 9am and 4pm (GTM+1).
If the customer does not reply to the e-mail notification within 3 days and does not select one of the offered options, the selected product will be delivered to the customer’s address by delivery service.
If the buyer refuses to receive the undamaged goods or does not pick them up at the courier’s office after the notification has been delivered to him, the seller has the right to ask the buyer to refund all shipping costs.
6. Refund / complaint
The buyer is obliged to check the correctness of the order, comparing the received products with the bill. If something is missing, he is obliged to file a written complaint to NASHE COSMETICS d.o.o. within 8 days of receiving the products from the delivery service. Subsequent complaints will not be accepted.
In case of return of goods, the buyer is obliged to make a justified complaint to NASHE COSMETICS d.o.o. by email, telephone or in mail.
The buyer is entitled to return the goods in the following cases:
- delivery of goods not ordered;
- delivery of expired goods;
- delivery of defective goods or damage that did not occur during transportation.

NASHE COSMETICS d.o.o. will acknowledge receipt of the complaint by e-mail and respond as soon as possible and no later than 15 days after receiving the complaint (in accordance with the Consumer Protection Act).
In case of a justified complaint, the buyer has the right to unilaterally terminate the contract, refund the amount paid or replacement of the product. In the event of replacement of the product, the buyer bears the cost of the new shipment and the cost of return is borne by NASHE COSMETICS d.o.o,.
7. Liability for material defects
Product data on the Internet site www.nashecosmetics.com is based on the NASHE COSMETICS d.o.o. database.
Product photos are for illustrative purposes only and do not necessarily correspond to the ordered products. NASHE COSMETICS d.o.o. points out that the visual identity of the product shown in the photo may not correspond to the product’s appearance, especially given the monitor settings on the customer’s computer, differences in color perception of how the customer sees them on the screen, etc.
In the case of the above discrepancy between the product shown in the photograph and the product supplied, this is not a defect in the product.
Product Information (product description, price, etc.) displayed on the NASHE COSMETICS d.o.o. web shop subject to bugs, application malfunctions, other technical imperfections, typographical errors, etc. In the case of obvious errors or malfunctions regarding product information displayed on the Website www.nashecosmetics.com, NASHE COSMETICS d.o.o. reserves the right to unilaterally terminate the contract.
NASHE COSMETICS d.o.o. is responsible for the material defects of the products it sells through the web shop, in accordance with the positive laws of the Republic of Croatia, in particular with the Civil Obligations Act.
NASHE COSMETICS d.o.o. is not be liable to the buyer or the recipient for minor scratches on products resulting from the delivery of goods through the delivery service, if the scratches or minor defects do not affect the basic characteristics and usability of the product.
NASHE COSMETICS d.o.o. is not be liable to the buyer or recipient if the technical capabilities of the buyer’s or recipient ‘s equipment are not sufficient for the proper use of the product and if the personal characteristics of the buyer or recipient are not sufficient for the use of the product.
NASHE COSMETICS d.o.o. will accept the return of expired goods and goods that have a fault or damage that did not occur in transportation at own expense, if it is determined that the complaint is justified and that the buyer has no liability.
In the event of defects in the product, the buyer can only terminate the contract if he has previously given the Seller a subsequent appropriate deadline for fulfilling the contract.
Right to unilaterally terminate the contract
Pursuant to the Consumer Protection Act, the buyer may unilaterally terminate the contract within 14 days without giving reasons.
The term for unilateral termination is 14 days from the date on which the order has been received. An order shall be deemed to have been received on the day on which the goods subject to the contract were handed over to the buyer or to a person designated by the buyer, who is not the carrier.
The buyer is not entitled to unilateral termination of the contract if:
- the object of the contract is sealed goods which for health or hygiene reasons are not suitable for return – if they were opened after delivery;
- the object of the contract is goods which, by their nature, are irreparably mixed with other contents after delivery;
- if the object of the contract is easily perishable goods or soon to be expired goods.
In order for the buyer to be entitled to unilaterally terminate the contract, he/she must notify NASHE COSMETICS d.o.o. on its decision to unilaterally terminate the contract before the above-stated deadline, by an unambiguous statement sent by mail or e-mail, stating its name, address, telephone, and e-mail address, and may use the enclosed sample of the Form for unilateral termination of the contract.

NASHE COSMETICS d.o.o. will send the confirmation of receipt of notice of unilateral termination of the contract to the buyer by e-mail without delay.

- printed and manually filled.
The manually filled form can be:
- scanned and sent by e-mail at email@example.com or
- mailed to NASHE COSMETICS d.o.o. Verudela 8, 52100 Pula, Croatia.
The buyer can fill out the form electronically by downloading it from our Website and opening it in the pdf document browser and clicking on “Tools”, then on “Fill and sign” and save the changes at the end of filling out.
If the buyer sends the form by mail or delivery service, the date printed with the postmark or the shipping parcel label will be considered as the date of mailing.
Should the buyer unilaterally terminate this Agreement, NASHE COSMETICS d.o.o. agrees to make a refund of the money received, minus the delivery costs, without delay, and no later than 14 days after the return of the goods or after receiving the proof that the goods have been shipped.
Refunds are made by paying into the customer’s current account. The buyer is obliged to send the goods without delay, not later than 14 days from the day when he submitted his decision of unilateral termination of the contract.
The direct cost of returning the goods is borne by the buyer.
The buyer is responsible for any impairment of the goods resulting from the handling of the goods, except for what was necessary to determine the nature, characteristics and functionality of the goods.
8. Final Provisions
NASHE COSMETICS d.o.o. reserves the right to change these Terms and may change them without notice and will not be liable for any possible consequences resulting from such changes. However, NASHE COSMETICS d.o.o. agrees to notify all registered users through the e-mail addresses they have entered at registration. Any changes will take effect immediately after being published on the Website www.nashecosmetics.com.
